By accessing or using Wiki POS, you agree to be bound by these Terms of Use. If you do not agree, you may not use our services. These terms apply globally to all users, including business owners and their employees, and comply with consumer protection laws in the EU, US, Canada, Australia, Brazil, and South Africa.
Wiki POS provides a cloud-based point-of-sale platform including sales processing, inventory management, customer loyalty programmes, invoicing, and reporting tools. We offer Trial, Basic, and Pro subscription plans.
You agree not to:
You retain ownership of all data you input into Wiki POS, including product catalogues, sales records, and customer information. We do not claim ownership of your business data. You may export your data at any time.
We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for losses resulting from service interruptions beyond our reasonable control.
To the maximum extent permitted by law in your jurisdiction, Wiki POS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total aggregate liability shall not exceed the amount you paid in the 12 months preceding the claim or $100 USD, whichever is greater. This limitation does not apply to fraud, gross negligence, or liabilities that cannot be excluded under mandatory consumer protection laws.
We reserve the right to suspend or terminate accounts that violate these terms. You may cancel your account at any time from your settings page. Upon termination, your data will be retained for 30 days before deletion.
These terms are governed by the laws of the Republic of South Africa, except where mandatory local laws apply. Any disputes shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the jurisdiction of South African courts, or the courts of your jurisdiction if you are in the EU (under GDPR) or US (under state laws). We accept alternative dispute resolution methods including mediation and arbitration where applicable.
We may update these terms from time to time. We will notify users of significant changes via email. Continued use of the platform after changes constitutes acceptance of the new terms.
